1. Introduction

Welcome to BarberFC ("BarberFC", "we", "us", or "our"). BarberFC is a football-centric media brand operating via its website at www.barberfc.com, its TikTok channel, its Instagram profile, and any associated digital products or services (together, the "Platform"). BarberFC is currently operated by its founding team based in England and Wales.

These Terms and Conditions ("Terms") govern your access to and use of the Platform. By accessing or using any part of the Platform — including signing up to our mailing list, completing a quiz, or following or interacting with our social media accounts — you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Eligibility and Age Restrictions

2.1 The Platform is intended for users aged 13 and over. By using the Platform you confirm that you are at least 13 years old.

2.2 If you are between 13 and 17 years old, you must have obtained the consent of a parent or guardian before using the Platform, registering an account, or providing any personal data.

2.3 We do not knowingly collect personal data from children under the age of 13. If we become aware that a child under 13 has provided personal data without verifiable parental consent, we will delete that data promptly. Parents or guardians who believe their child has submitted data to us should contact us at support@barberfc.com.

2.4 Where a specific feature requires a higher minimum age (for example, participation in competitions involving prizes or affiliate promotions), we will state this clearly at the point of entry.

3. Use of the Platform

3.1 You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of any third party or restrict or inhibit anyone else's use or enjoyment of the Platform.

3.2 You must not:

• Use the Platform in any way that breaches applicable local, national, or international law or regulation;
• Transmit any unsolicited or unauthorised advertising or promotional material (spam);
• Impersonate any person or misrepresent your affiliation with any person or entity;
• Submit false, misleading, or inaccurate information, including quiz answers intended to manipulate results;
• Attempt to gain unauthorised access to any part of the Platform or its related systems or networks;
• Scrape, harvest, or otherwise collect data from the Platform by automated means without our express written consent;
• Upload or transmit viruses, malware, or any other harmful or malicious code.

3.3 We reserve the right to suspend or terminate your access to the Platform at any time and without notice if we reasonably believe you have violated these Terms or if required to do so by law.

4. Accounts and Registration

4.1 Certain features of the Platform (including mailing list sign-up, quiz participation, and any future community features) may require you to provide personal information such as your name, email address, and favourite football club. You agree to provide accurate and up-to-date information.

4.2 Where you connect or interact with us via a third-party social login (for example, via Meta, Instagram, or TikTok), you authorise us to receive the profile information made available by that service, subject to your privacy settings on that platform and our Privacy Policy.

4.3 You are responsible for maintaining the confidentiality of any login credentials associated with your account and for all activity that occurs under your account. Please notify us immediately at support@barberfc.com if you become aware of any unauthorised use.

5. User Content

5.1 You may be invited to submit content to the Platform, including quiz responses, comments, opinions, and other materials ("User Content").

5.2 By submitting User Content you grant BarberFC a non-exclusive, royalty-free, worldwide, sublicensable, and transferable licence to use, reproduce, modify, publish, distribute, and display that User Content in connection with the operation and promotion of the Platform, including on our social media channels.

5.3 You represent and warrant that: (a) you own or have the necessary rights to submit your User Content; (b) it does not infringe any third-party intellectual property, privacy, or other legal rights; and (c) it does not contain any content that is unlawful, defamatory, obscene, or discriminatory.

5.4 We reserve the right (but not the obligation) to review, edit, or remove any User Content at our sole discretion and without notice.

6. Intellectual Property

6.1 All content on the Platform created by or for BarberFC — including videos, graphics, logos, quiz questions, and data compilations — is owned by or licensed to BarberFC and is protected by copyright and other applicable intellectual property laws.

6.2 You may not copy, reproduce, distribute, republish, download, display, post, or transmit any of our content in any form without our express prior written consent, except as necessary to use the Platform for its intended purpose.

6.3 The BarberFC name, logo, and any associated marks are owned by BarberFC. Nothing in these Terms grants you any right to use them without our prior written consent.

7. Sponsored and Commercial Content

7.1 Some content on the Platform — including posts, videos, quizzes, and emails — may be paid for by, or produced in collaboration with, commercial partners or sponsors ("Sponsored Content"). All Sponsored Content will be clearly identified in accordance with the ASA/CAP Code and any other applicable advertising standards.

7.2 We may promote products, services, or brands to you via email where you have given your consent to receive marketing communications from us or our partners. You may opt out at any time using the unsubscribe link in any email, or by contacting us at support@barberfc.com.

7.3 We may participate in affiliate programmes. This means we may earn a commission or other consideration if you click a link to a partner's product or service and make a purchase. All affiliate relationships will be disclosed at the point of promotion.

7.4 BarberFC does not endorse any specific product, service, or sponsor unless expressly stated. Partner and sponsor content is provided for informational or entertainment purposes only and should not be relied upon as professional advice.

7.5 We are not responsible for the content, accuracy, or practices of our commercial partners or sponsors. Any dispute regarding a partner's product or service should be raised directly with that partner.

8. Third-Party Platforms and Links

8.1 A significant portion of the Platform is distributed via third-party platforms including TikTok and Instagram (Meta). Your use of those platforms is governed entirely by those platforms' own terms of service and privacy policies, which we encourage you to read.

8.2 The Platform may contain links to third-party websites or services. We are not responsible for the content, availability, privacy practices, or terms of any linked third-party site, and inclusion of a link does not constitute endorsement.

8.3 Our website uses tracking technologies from third-party platforms including Google (GA4), Meta, and TikTok. These are described fully in our Privacy Policy, which forms part of these Terms.

9. Disclaimers

9.1 The Platform and all content are provided on an "as is" and "as available" basis without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

9.2 Football statistics, quiz content, opinions, and other editorial content are provided for entertainment purposes only and are not intended as professional or expert advice.

9.3 We do not guarantee that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

10. Limitation of Liability

10.1 To the fullest extent permitted by applicable law, BarberFC and its operators, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or in connection with your use of, or inability to use, the Platform.

10.2 Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under English law.

11. Changes to the Platform and Terms

11.1 We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time and without liability to you.

11.2 We may update these Terms from time to time. When we make material changes we will update the effective date at the top of this document and, where appropriate, notify you by email or via a notice on the Platform. Your continued use of the Platform after any change constitutes your acceptance of the updated Terms.

12. Governing Law and Jurisdiction

12.1 These Terms are governed by and shall be construed in accordance with the laws of England and Wales.

12.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, provided that we reserve the right to bring proceedings against you in the courts of any other applicable jurisdiction.

13. Miscellaneous

13.1 Entire agreement. These Terms, together with our Privacy Policy and any other policies published on the Platform, constitute the entire agreement between you and BarberFC with respect to your use of the Platform.

13.2 Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

13.3 Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

13.4 Assignment. You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations at any time.

14. Competitions and Prizes

14.1 From time to time we may run competitions, prize draws, or quiz-based contests via the Platform ("Competitions"). Participation in any Competition is subject to any specific rules published at the point of entry, which form part of these Terms.

14.2 Where a Competition involves a prize, entry is open to UK residents aged 18 or over unless otherwise stated. Employees and contractors of BarberFC and their immediate family members are not eligible to enter.

14.3 By entering a Competition you agree that if you win, we may announce limited winner information — such as your first name, last initial, general location (for example, your city or region), or entry reference number — for the purpose of confirming that the prize has been awarded. We will not publish your email address, phone number, full postal address, or other unnecessary personal information. You may object to your winner details being published by contacting us at support@barberfc.com before the announcement is made.

14.4 Prizes are non-transferable and no cash alternative will be offered unless required by law. We reserve the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.

14.5 We will endeavour to contact winners within 14 days of a Competition closing. If a winner cannot be contacted or fails to claim their prize within 28 days of notification, we reserve the right to draw an alternative winner.
