1. Who We Are and How to Contact Us

BarberFC ("BarberFC", "we", "us", "our") is a football-centric media brand based in England. We operate via our website at www.barberfc.com, our TikTok channel, our Instagram profile, and any associated digital products or services (together, the "Platform"). Barber FC is the data controller for the personal data we collect through the Platform.

2. What Personal Data We Collect

We collect and process the following categories of personal data:

2.1 Data you provide directly

  • Name and email address — when you sign up to our mailing list, waitlist, or a quiz.
  • Favourite football club — collected at sign-up or during quiz participation.
  • Quiz answers — your responses to football knowledge, opinion, and preference quizzes.
  • Any other information you voluntarily provide when contacting us, or interacting with our platforms.

2.2 Data from third-party social platforms

Where you interact with us via Instagram, TikTok, or connect using a Meta social login, we may receive profile information made available by that platform, subject to your privacy settings on that platform. This may include your public profile name, profile picture, and email address (where permitted). We only use data received from third-party platforms as described in this Policy and within the permissions you have granted on that platform.

2.3 Data we collect automatically

When you visit our website we automatically collect certain technical and behavioural data via cookies and tracking technologies (see Section 8):

  • Usage data — pages visited, time on page, quiz completion rates, links clicked.
  • Device and technical data — IP address, browser type and version, operating system, referral source.
  • Cookie and tracking data — via the tools listed in Section 8.

2.4 Aggregated and derived data

We analyse quiz answers and behavioural data to produce aggregated audience insights (for example, "X% of BarberFC followers support Premier League clubs" or trending quiz response patterns). This data may not identify you individually and may be shared with commercial partners as described in Section 5.

3. Legal Basis for Processing Your Data (UK GDPR)

We are required by UK GDPR to identify a lawful basis for each type of processing we carry out. The bases we rely on are:

3.1 Consent (Article 6(1)(a))

  • Sending you BarberFC marketing emails, newsletters, and quiz invitations.
  • Sending you promotional emails on behalf of commercial partners and sponsors.
  • Placing non-essential cookies and tracking pixels on your device (including Meta Pixel, TikTok Pixel, and analytics cookies).
  • Sharing your personal data (name, email, team preference) with named third-party commercial partners.

You may withdraw your consent at any time without affecting the lawfulness of processing before withdrawal. To withdraw: use the unsubscribe link in any email, update your cookie preferences via our cookie consent tool, or contact us at legal@barberfc.com.

3.2 Legitimate interests (Article 6(1)(f))

  • Analysing how visitors interact with the Platform to improve our content and user experience.
  • Producing anonymised, aggregated audience insights for internal use and partner reporting.
  • Internal operational data management, including filtering and organising subscriber and quiz data for BarberFC team use.
  • Announcing limited winner information (first name, last initial, general location, or entry number) following a Competition, to confirm publicly that a prize has been awarded.
  • Fraud prevention, security monitoring, and protection of the Platform.

We have carried out a legitimate interests assessment and are satisfied that our interests are not overridden by your rights and freedoms. You have the right to object to processing based on legitimate interests — see Section 7.

3.3 Contract performance (Article 6(1)(b))

Where you enter a contract with us (for example, to purchase a product or service), we will process the personal data necessary to fulfil that contract.

4. How We Use Your Personal Data

We use your personal data for the following purposes:

  • To operate, maintain, and improve the Platform and its content.
  • To send you BarberFC newsletters, content updates, quiz invitations, and marketing (with your consent).
  • To send you promotional offers from selected commercial partners and sponsors.
  • To personalise the quiz experience and content recommendations.
  • To compile aggregated audience insights for internal analysis and commercial partner collaboration.
  • To measure the performance of our advertising campaigns via tracking pixels.
  • To comply with legal and regulatory obligations.
  • To administer Competitions, notify winners, and publish limited winner information (first name, last initial, general location, or entry reference number) to confirm that a prize has been awarded — see Section 14 of our Terms.
  • To detect, investigate, and prevent fraud, abuse, or misuse of the Platform.

5. Who We Share Your Personal Data With

5.1 Data processors acting on our behalf

We use the following service providers who process personal data on our behalf and are bound by data processing agreements:

  • Klaviyo (Klaviyo, Inc., USA) — email marketing and CRM platform. Processes your name, email address, team preference, quiz answers, and email engagement data on our behalf.
  • Google LLC (USA) — Google Analytics 4 (GA4) for website analytics. Processes anonymised and pseudonymised usage and device data.
  • Meta Platforms, Inc. (USA) — Meta Pixel for advertising measurement and audience building on Facebook and Instagram. Processes device identifiers and behavioural data where you have consented to marketing cookies.
  • TikTok (TikTok Information Technologies UK Limited / TikTok Inc.) — TikTok Pixel for advertising measurement and retargeting. Processes device identifiers and behavioural data where you have consented to marketing cookies.
  • Airtable (Airtable, Inc., USA) — internal data management. Processes name, email address, team preference, and quiz answers on our behalf for internal operational and filtering purposes.
  • Wheel of Names (wheelofnames.com) — competition winner selection tool. Processes first names, last initials, and football club preference on our behalf for the purpose of randomly selecting Competition winners. Email addresses and other contact details are not passed to this service.

5.2 Commercial partners and sponsors — direct marketing

We may share your name, email address, and football club preference with commercial partners or sponsors where you have consented to this.

5.3 Audience insights shared with partners

We may share audience insights with partners and sponsors (for example, quiz trend data, demographic breakdowns, engagement statistics). This data cannot be used to identify you individually and does not constitute sharing of personal data.

5.4 Legal and regulatory disclosures

We may disclose your personal data to law enforcement authorities, regulators, or courts where required to do so by applicable law, or where necessary to protect our legal rights or the safety of our users.

6. International Data Transfers

Several of our service providers are based outside the UK, including in the United States (Klaviyo, Google, Meta, TikTok Inc.). When we transfer personal data outside the UK we ensure that appropriate safeguards are in place as required by UK GDPR, including:

  • Standard Contractual Clauses (SCCs) or the UK International Data Transfer Agreement (IDTA);
  • adequacy decisions made by the UK Secretary of State; or
  • other approved transfer mechanisms.

7. Your Data Protection Rights

Under UK GDPR you have the following rights in relation to your personal data:

  • Right of access — to request a copy of the personal data we hold about you (Subject Access Request).
  • Right to rectification — to request correction of inaccurate or incomplete data.
  • Right to erasure ("right to be forgotten") — to request deletion of your data in certain circumstances.
  • Right to restriction — to ask us to limit how we process your data in certain circumstances.
  • Right to data portability — to receive your data in a structured, commonly used, machine-readable format.
  • Right to object — to object to processing based on legitimate interests, or to direct marketing at any time.
  • Right to withdraw consent — where we rely on consent, you may withdraw it at any time without penalty.

To exercise any of your rights, contact us at legal@barberfc.com. We will respond within one calendar month. If you are not satisfied with our response, you have the right to lodge a complaint with the ICO at ico.org.uk.

8. Cookies and Tracking Technologies

We use cookies and similar tracking technologies on our website. Our cookie consent management platform (CMP) allows you to accept, reject, or customise your cookie preferences when you first visit the site and at any time thereafter via the cookie preference centre in the website footer.

8.1 Categories of cookies we use

Strictly necessary cookies

Essential to make the website function. These do not require your consent and cannot be disabled via our CMP.

Analytics cookies (consent required)

  • Google Analytics 4 (GA4) — tracks how visitors use our website. Data is pseudonymised before transmission where possible.

Marketing and advertising cookies (consent required)

  • Meta Pixel — measures conversions from Facebook and Instagram ads and enables lookalike and retargeting audiences.
  • TikTok Pixel — measures conversions from TikTok ads and enables retargeting.

Email tracking (Klaviyo)

Emails sent via Klaviyo contain tracking pixels that record when an email has been opened and which links have been clicked. You may limit email tracking by disabling image loading in your email client, or by unsubscribing.

8.2 Managing your cookie preferences

You can manage or withdraw your cookie consent at any time via the cookie preference centre accessible from the footer of our website.

9. Data Retention

  • Mailing list data (name, email, team preference, quiz answers, engagement history): retained while you remain subscribed and for up to 12 months after unsubscription or last engagement, unless you request earlier deletion.
  • Social login and third-party profile data: retained for the duration of your use of connected features and deleted upon your request.
  • Website analytics data: up to 14 months in GA4; aggregated reports may be retained indefinitely.
  • Advertising pixel data: subject to the respective platform's own retention periods (typically 180 days for event data).
  • Data shared with commercial partners: partners are contractually required to delete your data once the relevant campaign or consent period ends.

10. Children's Privacy

The Platform is not directed at children under the age of 13. Users between 13 and 17 should ensure they have parental or guardian consent before providing personal data.

If you are a parent or guardian and believe your child under 13 has submitted personal data to us, please contact us at support@barberfc.com and we will take prompt steps to delete it.

11. Security

We implement appropriate technical and organisational measures to protect your personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, or access. Measures include TLS/HTTPS encryption, access controls, and periodic review of our data handling practices.

In the event of a personal data breach likely to result in a risk to your rights and freedoms, we will notify the ICO within 72 hours of becoming aware of the breach and, where required, will notify you directly.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our data practices, technology stack, or legal obligations. When we make material changes we will update the effective date at the top of this document and notify you by email or via a prominent notice on the Platform.

Your continued use of the Platform after any update constitutes your acknowledgement of the revised Policy.
